Smeagol has nothing on UTubeSo, what do you do after you’ve struck domain gold? Well, UTube, the company that sells … well, tubes and other things, opted, it sounds like, to NOT sell their domain name to YouTube for a princely sum in the domain of 7 figures because they were holding out for MORE.

So, instead of taking the generous buyout for their domain name what do they do?

They decide to haul in the lawyers.

Christ almighty.

As reported by the local ABC news affiliate in Ohio (Go KLTV!) (tip: mashable):

According to the company, Universal Tube’s lawsuit asks that YouTube, Inc. stop using the youtube.com domain or pay Universal Tube for the cost of creating a new domain that will not be confused with youtube.com. The company also wants YouTube to cover the cost of creating new corporate identity and marketing materials to support the new Internet identity.

UTube’s song and dance number involves the awful cost of bandwidth because the number of pagehits has skyrocketed to 2M pageviews per monnth.  Insert obligatory asking of “whine” with that cheese … wait for it … right … now.

Of course, I Am Not A Lawyer, but it seems utterly ridiculous to ask YouTube to pay for all those damages when they’re not even directly responsible for spillover traffic.  In fact, in my totally unqualified lawyering opinion, these claims seem frivolous, and another grab at getting cash from YouTube — particularly since it was gobbled up by Google, who seems to have a giant warchest full of cash to deal with litigious claims (perhaps to the tune of  $500M if Mark Cuban is to be believed).

But then again … I’m not a lawyer. :)
